Site Background

Nasty Jack’s Antiques is located at 103 Morris Street, La Conner, Washington. The property consists of a retail antique store, a furniture refinishing shed, and a parking lot. Surrounding property use is a mixture of residential and commercial.

Furniture refinishing activities are conducted in a shed east of the retail shop, and include stripping, wiping, and washing down of furniture. In the past, stripped furniture was taken outdoors onto the unpaved parking area to be washed and wiped down.

Lead was detected in soil above the state cleanup standards (MTCA Method A cleanup level) in the parking lot to a depth of approximately two feet. The source of contamination appeared to be lead-based paint residuals from the former outdoor wipe and wash-down area associated with furniture stripping. Lead concentrations were significantly lower than the cleanup level deeper than two feet.

Cleanup Remedy And Regulatory Status

Nasty Jack’s Antiques entered into the Voluntary Cleanup Program (VCP) at the Department of Ecology (Ecology). On-site containment was selected as the remedy to address the lead contamination in the near surface soils. The parking lot was paved with asphalt in 2006.

A restrictive covenant was placed on the property to ensure remedy performance and to restrict activities that might result in exposure to contaminants. The Site received a No Further Action (NFA) determination in 2006.

Periodic Review Results

The remedial actions completed at the Site appear to be protective of human health and the environment.

Soil cleanup levels have not been met at the Site; however, the cleanup action was determined to comply with cleanup standards under WAC 173-340-740(6)(f), since the long-term integrity of the containment system is ensured and the requirements for containment technologies have been met.

The environmental covenant for the property is in place and continues to be effective in protecting public health and the environment from exposure to hazardous substances, as well as protecting the integrity of the remedial action.

Based on this periodic review, Ecology has determined that the requirements of the environmental covenant continue to be met. No additional cleanup actions are required by the property owner at this time. It is the property owner’s responsibility to continue to inspect the Site to assure that the integrity of the remedy is maintained.

Voluntary Cleanup Program

This site was cleaned up under our Voluntary Cleanup Program, which provides technical help to owners of contaminated sites.

Voluntary Cleanup Program customers pay fees to cover our costs for technical help and reviewing cleanup reports. Sites in this program must meet the same cleanup standards as the sites Ecology manages under legal orders.

Site use restrictions called institutional controls are in effect

Institutional controls can be fences, signs, or restrictions on how the property is used. For instance, an institutional control may prohibit installing drinking water wells or disturbing a protective cap that isolates contamination. These restrictions keep the contamination contained and keep people from being exposed to the contamination. The controls are usually listed in environmental covenants recorded with the county.

Periodic reviews are required when institutional controls are required at a site. Ecology conducts reviews to make sure the controls remain effective and the cleanup still protects human health and the environment. We conduct periodic reviews about every five years.
