Description The Model Toxics Control Act (MTCA), Chapter 70.105D RCW, requires the Department of Ecology (Ecology) to establish a program to identify sites potentially contaminated with hazardous substances. That program is set forth in WAC 173-340-300, which is part of the MTCA Cleanup Regulation, chapter 173-340 WAC. Under that program, Ecology requires owners and operators to report releases of hazardous substances occurring as consequence of past practices. Releases occurring as a consequence of current practices must be reported under other authorities.

This policy provides guidance on the types of releases that should be reported under WAC 173-340-300 and the procedures for reporting such releases.
