Description This rule amendment has been reviewed under Chapter 19.85 RCW (the Regulatory Fairness Act). This analysis addresses the requirement for a Small Business Economic Impact Statement (SBEIS). This SBEIS reviews the proposed rule rather than the change to the rule because the change is large and the relative impact of the rule on small vs. large business remains constant. These amendments have a disproportionate impact on small businesses in some sectors of the economy. Mitigation has been provided where it is legal and feasible. In so far as small businesses tend to construct, own, or operate smaller dams, the structure of the fees will reduce the disproportionate impact to some extent.
