Description The purpose of this policy is to provide guidance to Washington State Department of Ecology staff and other interested persons. The guidance helps implement WAC 173-340-550(7). This provision of the Model Toxics Control Act regulations (also called the MTCA Rule or Cleanup Rule) provides for prepayment of Ecology's oversight costs to enable resources to be dedicated to the oversight of cleanup at lower priority sites.

This policy outlines the requirements and limitations of these agreements. It is not intended to address Independent Cleanups where a person is seeking technical assistance through Ecology's Voluntary Cleanup Program (VCP). For information about the VCP, visit: https://ecology.wa.gov/Spills-Cleanup/Contamination-cleanup/Cleanup-process/Cleanup-options/Voluntary-cleanup-program

REVISION NOTE: This policy became effective June 30, 2006. In September 2018, we formatted the document, added Americans with Disabilities Act (ADA) language, and cataloged it in Ecology’s publications database. With the exception of ADA language, content of this policy did not change since it became effective June 30, 2006.
