Description The Department of Ecology is proposing to amend Chapter 173-160 WAC: Minimum Standards for Construction and Maintenance of Wells. Notice of
the proposed rule will be in the Washington State Register on October 15,2008.

The purpose of the rule amendment is to make typographical and technical corrections. Ecology has also added new sections to the rule that limit the use of specific drilling materials to help prevent contamination of ground water.

Ecology worked on the changes for two years with the Technical Advisory Group (TAG), which was created by the Legislature. The TAG is chaired by Ecology and composed of drillers, health officials, an engineer, a hydrogeologist, and Ecology staff.

A preliminary cost-benefit analysis for this rule amendment is available for public and agency review and comment until November 13, 2008. Ecology
has issued a Determination of Nonsignificance (DNS) under the State Environmental Policy Act, and it is available on our Web site. A Small Business Economic Impact Statement was not prepared since it is exempt
under RCW 18.85.020(2) and RCW 18.85.030.
