Description Ecology is using a pilot rule development process to field-test the draft rule. Last year, an advisory group of stakeholders and manufacturers of children’s products identified issues and proposed solutions to be considered in the rulemaking process. A pilot rule is now being voluntarily tested by a group of children’s products manufacturers recruited by Ecology.


Using the pilot rule process provides businesses, as well as the state, an opportunity to understand and prepare for the issues presented by the reporting process.


At the end of the pilot test phase in April 2010, Ecology will assess and summarize results from each participating company and prepare a report documenting what was learned. Results of the pilot project will be used to decide if the draft rule needs to be adjusted before proceeding with the rule adoption process.


Once rules are finalized and adopted, manufacturers will be required to report to Ecology if listed chemicals are present in any of their children’s products. The pilot rule will help Ecology specify how and when that reporting will occur.
