| Description | The Washington State Department of Ecology (Ecology) is proposing this rule for the Upper Kittitas County Groundwater Area to prevent additional adverse effects on flows and senior water rights in the Yakima River and its tributaries. The proposed rule withdraws all unappropriated groundwater in accordance with RCW 90.54.050(2) due to insufficient information. A groundwater study the Legislature funded in 2009 will be performed. The Groundwater Code, Chapter 90.44 RCW, is supplemental to Chapter 90.03 RCW, which regulates the surface waters of the state. The Legislature enacted the Groundwater Code to extend the application of such surface water statutes to the appropriation and beneficial use of groundwater within the state. Ecology is developing and issuing this Small Business Economic Impact Statement (SBEIS) as part of its rule adoption process and to meet Chapter 19.85 RCW. Ecology intends to use the information in the SBEIS to ensure that the proposed rule is consistent with legislative policy. |
