Description In 2001, the Department of Ecology (Ecology) adopted an instream resources protection program for the Skagit River Basin (WAC 173-503). In 2006, Ecology amended the rule to reserve a one-time limited amount of water for future out-of-stream uses. The reserve water for residential and commercial growth is distributed in specific amounts among 25 subbasins, including Carpenter-Fisher.

Recent data on the Carpenter-Fisher subbasin shows that the reserve has been used up. According to the rule, once all the water reserved for a subbasin is distributed, the area is closed to new unmitigated water uses (that is, water uses whose impact is not offset or compensated for). Ecology is following the process as required by the rule and closing the subbasin.
