Description The Washington State Department of Ecology is exercising enforcement discretion on hydrofluorocarbon (HFC) restrictions for data center refrigeration equipment under WAC 173-443-040(2), Table 2. The enforcement date for new data center industrial process refrigeration equipment will be delayed from January 1, 2025, to January 1, 2027. This decision accounts for recent federal rule changes and the evolving availability of low-GWP refrigerants. Other industrial process refrigeration remains subject to existing restrictions. This statement applies to manufacturers, distributors, retailers, and equipment owners and ensures compliance pathways align with state and federal regulations while supporting industry transitions.
