Description In 2023, the Washington State Legislature passed Chapter 70A.555 RCW Batteries—Environmental
Stewardship to establish a new extended producer responsibility program for battery collection in
Washington. The program will be funded by producers and free for all Washington residents to drop
off their unwanted batteries. The new law requires the Department of Ecology to adopt rules to
implement the program.

This new rule chapter establishes:

• Processes and procedures that the department and battery stewardship organizations use to
oversee and administer the program.

• Fees to be paid to the department to cover the agency’s full costs of providing oversight of the
implementation, administration, and enforcement of the program.

• Requirements for producers to mark batteries with their identification, an identification of the
chemistry of the battery, and an indication that batteries should not be discarded with
household garbage.

• Standards to ensure the safe and effective collection and handling of batteries through a
stewardship program.
