Background
Status
Ecology identified the potential presence of COPCs, including petroleum products, metals, semi-volatile organic compounds, volatile organic compounds, polychlorinated biphenyls, and dioxins/furans from the 1991 initial investigation. An independent investigation and cleanup occurred in 2010 to support the installation of a boat ramp between the north and south portions of the Site. An additional investigation occurred in 2011 to address data gaps in the southern portion of the Site.
Targeted excavation and off-site disposal occurred during the 2013 cleanup action at soil borings that had analytical exceedances above Model Toxics Control Act (MTCA). Approximately 18 cubic yards of soil was excavated and disposed of during this cleanup.
Following the 2013 cleanup action, a No Further Action opinion letter was issued by Ecology in September 2014 with an environmental covenant consisting of an Ecology approved soil management plan to be implemented. As part of the soil management plan, Ecology will be notified in advance of any site soil disturbance activities. In 2024 the environmental covenant was filed with the county. The environmental covenant lists this key requirement:
- Groundwater beneath the site shall not be extracted for any purpose other than temporary construction dewatering, investigation, monitoring, or remediation.
Site use restrictions called institutional controls are in effect
Institutional controls can be fences, signs, or restrictions on how the property is used. For instance, an institutional control may prohibit installing drinking water wells or disturbing a protective cap that isolates contamination. These restrictions keep the contamination contained and keep people from being exposed to the contamination. The controls are usually listed in environmental covenants recorded with the county.
Periodic reviews are required when institutional controls are required at a site. Ecology conducts reviews to make sure the controls remain effective and the cleanup still protects human health and the environment. We conduct periodic reviews about every five years.

Public Comment Period
Ecology visited the site December 17, 2024. The cleanup action is effectively protecting human health and the environment from exposure to hazardous substances. An environmental covenant for the property is in place to protect the cleanup action and ensure it keeps working.
We will review comments received during the comment period and make recommendations for suggested changes. The periodic review will become final if no significant changes are made. We will hold an additional public comment period if we make significant changes.
Site history
The southern portion of the site was created in 1974 using sediment from dredging the navigation channel in Fidalgo Bay. Between 1991 to 2011, investigations found contamination in the soil and groundwater.
In 2010, about 3,291 cubic yards of contaminated soil were removed during the construction of a boat ramp and sent to a landfill. In 2013, another 39 cubic yards were removed with follow-up testing. However, groundwater at the site is still contaminated, so in 2024, restrictions were put in place to prevent its use.

Next steps
Ecology will review all comments received during the comment period and update the periodic review if needed. If no significant changes are made, the periodic review will become final. If significant changes are made, an additional public comment period will be held. We will hold a public meeting if 10 or more people request one.
