SMI Inc Trust
This site has contamination from auto maintenance work. It is awaiting cleanup and characterization.
The SMI Inc. Trust site includes two parcels, 8701 and 8733 Greenwood Avenue N. The contamination likely came from activities on the 8733 parcel and spread to the neighboring property. The 8701 parcel also has another contaminated site, Texaco 211544. As part of the Texaco cleanup, Ecology placed an environmental covenant on the part of the property contaminated by the SMI Inc. Trust site.
Background
In 1998 Ecology received a report about poor waste management practices at 8733 Greenwood Ave N. King County Public Health visited the site and noted damaged asphalt pavement in the auto maintenance area and leaking waste oil storage drums. Three soil samples collected from surface soils in 2004 contained cadmium and lead above the level allowed by Washington's cleanup law, the Model Toxics Control Act (MTCA).
Environmental Covenant On The 8701 Parcel
The Texaco 211544 site is on the 8701 Greenwood parcel, directly to the south of the 8733 parcel where the original SMI Inc. Trust releases were recorded. In 2023, an environmental covenant was recorded for the 8701 parcel as part of the Texaco 211544 cleanup. Soils on the north boundary of the 8701 parcel contained gasoline- (TPH-G) and diesel-range (TPH-D) total petroleum hydrocarbons above the level allowed by MTCA.
The covenant requires the following on the restricted area of the 8701 parcel:
- The property owners must maintain an asphalt cap over the contaminated soil. They must inspect the cap annually to ensure its efficacy. If the owners wants to remove the cap, they must notify Ecology and we must approve their plan.
- No one may extract groundwater that could be affected by the restricted area, except for investigation, monitoring, or cleaning up contamination. Drilling a well for water supply is strictly prohibited.
- No new storm water infiltration facilities may be constructed within the restricted area. If new stormwater systems are proposed, they must be of watertight construction and Ecology must approve them before installation.
Site use restrictions called institutional controls are in effect
Institutional controls can be fences, signs, or restrictions on how the property is used. For instance, an institutional control may prohibit installing drinking water wells or disturbing a protective cap that isolates contamination. These restrictions keep the contamination contained and keep people from being exposed to the contamination. The controls are usually listed in environmental covenants recorded with the county.
Periodic reviews are required when institutional controls are required at a site. Ecology conducts reviews to make sure the controls remain effective and the cleanup still protects human health and the environment. We conduct periodic reviews about every five years.
