Earlier this year, several draft documents were available for public comment. These documents provide a path forward to address contamination at this site.

We received no comments and the documents are now final. These documents include:
  • A legal agreement, called an Agreed Order that provides an overview of the site and the cleanup work to be done.
  • dangerous waste permit for corrective action. This document includes the  2018 Corrective Action Plan that outlines steps to be taken to address contamination.
  • public participation plan that outlines how Ecology will inform the public about this site.

Site Background

The Site is the location of zinc micronutrient fertilizer manufacturing. Raw materials used in the manufacturing processes were dry, powder or granular, ash-like materials rich in zinc and other metals. These materials were typically reacted with sulfuric acid to extract the zinc. The final product was dried into granules or retained in liquid form, then sold for agricultural use.

Site Contamination And Past Cleanup

There is no risk to the public
Chemicals can enter the body through touching, breathing, and drinking. The contaminated soils are beneath pavement or buildings and the groundwater does not reach any surface water. There are no drinking water wells near the contamination and drinking water wells are much deeper than where the contamination is located. 
Product storage and handling practices and product spills at the facility have resulted in releases of hazardous substances to the soil and groundwater.

In November 2000, the United States Environmental Protection Agency identified areas where hazardous chemicals may have been released. In August 2002, Ecology and Bay Zinc entered into a legal agreement to address contaminated soil and groundwater at the
facility.

Soil on- and off-property is contaminated with lead, cadmium, zinc, and dioxin. Between October 2002 and June 2005, Bay Zinc excavated and disposed of over 12,320 tons of contaminated soils. In all but three areas that were under buildings or pavement, soil met cleanup levels that protect people and the environment. Ecology allowed contaminated soils to remain in these areas because they pose no immediate risk. However, the soil in these areas cannot be disturbed without consulting with and receiving permission from Ecology in accordance with an environmental covenant. Groundwater on- and off-property is contaminated with cadmium, zinc, sulfate, chloride, and manganese. Since 1985, previous property owners have cleaned up and monitored groundwater. Between 2003 and 2006, Bay Zinc cleaned up groundwater using a pump-and-treat system. According to the current monitoring results, the groundwater beneath the facility remains contaminated above cleanup levels.

Remedial Investigation/Feasibility Study report was prepared to determine the location and amounts of hazardous materials in soil and groundwater, along with alternatives that could be used to clean up the affected areas. The report also contains multiple cleanup alternatives that could be used to remove, treat, and contain the affected materials.

Cleanup Action Plan for this site requires Bay Zinc Co. to:

  • Excavate and dispose contaminated soils to an appropriate landfill.
  • Remove and treat contaminated groundwater.
In addition, an environmental covenant was placed on the property for some areas that were unable to meet cleanup standards.  Despite use of the pump and treat system, groundwater remains contaminated with low levels of metals and inorganics, and monitoring continues at the site.

Why we need to do more

Ultra Yield and Mr. Camp are now named as permittees in the legal documents. To make sure they comply with our cleanup laws, we are revising old cleanup documents and emphasizing the cleanup work that needs to continue. Ecology believes it is in the public interest that the permittees follow the environmental covenant and continue to monitor groundwater.

What’s next for soil cleanup?
Ultra Yield and Mr. Camp will comply with the institutional control requirements listed in the facility’s environmental covenant. The soil in these areas cannot be disturbed without consulting with and receiving permission from Ecology. If any contaminated soil is excavated, such excavated soil will be properly managed and disposed of at authorized facilities. Soil used to refill excavated areas will come from uncontaminated property.

A field professional will oversee and document the work performed to:
  • Ensure material is properly managed.
  • Monitor health and safety procedures to assure compliance with a Health and Safety Plan.
  • Test for cadmium, lead, and zinc in the excavated area(s) to document that the soil cleanup levels have been met.
What’s next for groundwater cleanup?
Ultra Yield and Mr. Camp will use Monitored Natural Attenuation (MNA) to address groundwater contamination. MNA uses natural biological and chemical processes to break down contamination into non-toxic chemicals that do not pose a risk to human health and the environment. Ultra Yield and Mr. Camp will monitor the progress regularly and report back to Ecology. If we believe that MNA is not working as planned, we may require Ultra Yield and Mr. Camp to do more to clean up groundwater.

Al corriente, Ultra Yield Micronutrients (Ultra Yield) opera una planta de producción de fertilizante micronutriente en el 213 de la Avenida West Moxee en Moxee. Previamente, Bay Zinc Company, Inc. (Bay Zinc) eran dueños y operaban las facilidades seguidos por Kronos Micronutrients, L.P. Ultra Yield compró los bienes de Kronos en marzo del 2017 y comenzó a rentar la propiedad sobre cual la planta está localizada del dueño y antiguo presidente de Kronos, Richard J. Camp, Jr.

Contaminación En El Sitio Y Acciones Previas De Limpieza

¿Qué pasará luego con la limpieza del suelo?

Ultra Yield y Mr. Camp cumplirán con los controles requeridos y detallados en el pacto ambiental de la facilidad.   • Correr análisis de cadmio, plomo, y zinc en las áreas excavadas para documentar que los niveles delimpieza se han cumplido.
¿Que pasará luego con la limpieza del agua subterránea?
Ultra Yield y Mr. Camp utilizarán Atenuación Natural Monitoreada (MNA, por sus siglas en inglés) para abordar la contaminación en el agua subterránea. MNA utiliza procesos químicos y biológicos naturales para descomponer la contaminación en sustancias químicas que no so tóxicas y que no representan un riesgo a la salud humana y al medio-ambiente. Ultra Yield y Mr. Camp monitorearán el progreso regularmente y le reportarán a Ecología. Si nosotros creemos que el MNA no está funcionando como planeado, es posible que le exijamos a Ultra Yield y Mr. Camp hacer más para limpiar el agua subterránea.

Site use restrictions called institutional controls are in effect

Institutional controls can be fences, signs, or restrictions on how the property is used. For instance, an institutional control may prohibit installing drinking water wells or disturbing a protective cap that isolates contamination. These restrictions keep the contamination contained and keep people from being exposed to the contamination. The controls are usually listed in environmental covenants recorded with the county.

Periodic reviews are required when institutional controls are required at a site. Ecology conducts reviews to make sure the controls remain effective and the cleanup still protects human health and the environment. We conduct periodic reviews about every five years.
