Description This policy provides guidance for Washington State Department of Ecology (Ecology) staff who work on cleanup sites under the Model Toxics Control Act (MTCA). MTCA requires Washington state to seek to recover from potentially liable persons or parties the amounts spent for investigative and remedial actions, agreed orders, enforcement orders, and consent decrees. MTCA also authorizes Ecology to recover the cost of providing advice and assistance to people who conduct independent remedial actions. This policy informs Ecology staff on how to fulfill these statutory mandates and authorities related to cost recovery.

REVISION NOTE: This policy became effective December 15, 1993, and was revised on December 31, 2017. In September 2018, we formatted the document; added a References page; updated the language for Americans with Disabilities Act (ADA); and cataloged it in Ecology’s publications database. With the exception of these additions, the content of this policy did not change since it was revised December 31, 2017.
