| Description | Washington state’s Underground Storage Tank (UST) regulations, Chapter 173-360, are known as “the UST rule.” On July 18, 2018, Washington State Department of Ecology (Ecology) repealed Chapter 173-360 and adopted new UST rule, Chapter 173-360A. The new rule is effective beginning October 1, 2018. The UST rule governs the installation, operation, maintenance, and closure of underground storage tank systems that contain petroleum or other regulated substances. The rule also governs the detection of, responses to, and financial responsibility for releases from those systems. This report presents the determinations made by Ecology as required under Chapter 34.05 RCW and Chapter 19.85 RCW for the adopted amendments to the UST Rule. Analyses include 1) Final Cost-Benefit Analysis; 2) Least-Burdensome Alternative Analysis; 3) Administrative Procedure Act Determinations; and 4) Regulatory Fairness Act Compliance. |
