Description Ecology is entering into a legal agreement called Agreed Order (AO) DE 19602. The agreement is between Ecology and NuStar Terminals Operations Partnership L.P. (NuStar) to clean up contamination. NuStar is the potentially liable person (PLP) responsible for cleanup at the Site. Ecology invites you to review and comment on the documents listed in the fact sheet. The Site is located at the 5400 block on the west side of NW Fruit Valley Road. NuStar owns the property. The property is a tank farm with seven large aboveground storage tanks used to store petroleum products. In 2001, Ecology learned about a gasoline spill and investigations showed that gasoline, diesel, naphthalene and BTEX (benzene, toluene, ethylbenzene and xylenes) contaminated soil and groundwater that needs to be addressed under the state’s cleanup law, the Model Toxics Control Act (MTCA). Contamination needs to be cleaned up in three areas at the Site.
NOTES Links to all the documents are placed on the Site webpage and the documents are uploaded to DSARS. The fact sheet mailer will be mailed to residents at addresses about ¼ mile from the Site and others who have expressed interest in cleanup sites in the vicinity. Ecology invites you to review and comment on the following documents.
