Description The Department of Ecology (Ecology), Haack Brothers Inc., and the City of Everett (City) propose amending the environmental covenant for Legion Memorial Golf Course to exclude the Haack Parcel.

In 2020, the City sold a parcel of the golf course property to Haack Brothers Inc. The property is called Haack Parcel (Property). It’s located on the eastern portion of the Legion Memorial Golf Course at 413 Rockefeller Avenue (Parcel number 00438610400600; the Property), overlooking the 15th green and 16th tee.

An environmental covenant was placed on the Site in December 2008 to address lead and arsenic contamination on the course. Covenant requirements limit people coming in contact with contaminated soil by requiring the upkeep of a clean soil cover on the course and upkeep of the clubhouse and parking lot.

Soil contaminated with arsenic and lead was removed from the Property in 2021. Soil was excavated from six areas of the Property and transported off site for disposal. Soil samples were collected from the excavations and analyzed to ensure soil meets state cleanup standards.

The Property was cleaned up under the Voluntary Cleanup Program (VCP). Under the VCP, participants can clean up contamination to meet the state cleanup standards under the Model Toxics Control Act, Washington’s hazardous waste cleanup law. Ecology provides technical and regulatory review assistance through the VCP.

The cleanup conducted at the Property was successful in removing all remaining contaminated soil. Ecology has determined an environmental covenant is not necessary at the Property for protection of human health and the environment. Ecology is recommending amending the environmental covenant to remove the Haack Parcel from the original environmental covenant agreement.
