Description On August 23, 2023, the Department of Ecology (Ecology) adopted amendments to Chapter 173-340 WAC, the Model Toxics Control Act (MTCA) Cleanup Regulations. The regulations govern the investigation and cleanup of sites in Washington state contaminated by the release of hazardous substances. Ecology conducted this rulemaking to update and clarify many of the administrative and procedural requirements for cleaning up contaminated sites. The updated regulations will be effective on January 1, 2024.
The purpose of this rule implementation plan (RIP) is to inform those who must comply with the rule amendments about how Ecology intends to:

• Implement and enforce the rule.
• Inform and educate affected persons.
• Promote and assist voluntary compliance.
• Evaluate whether the rule is achieving its purpose.
• Train and inform Ecology staff.
This plan also identifies:
• Supporting documents and tools that may need to be developed or updated.
• Other resources where more information about the rule is available.
• Persons who can answer questions about rule implementation.
This documentation is required by the Administrative Procedure Act (RCW 34.05.328).
