Description On August 23, 2023, the Washington State Department of Ecology (Ecology) adopted amendments to the Model Toxics Control Act (MTCA) Cleanup Regulations, Chapter 173-340 WAC. The regulations govern the investigation and cleanup of sites contaminated by the release of hazardous substances. Ecology conducted this rulemaking to update and clarify many of the administrative and procedural requirements for cleaning up contaminated sites. The updated regulations will be effective on January 1, 2024.

This Concise Explanatory Statement (CES) provides reasons for adopting the rule amendments, describes differences between the proposed and adopted rule amendments, and provides Ecology’s response to public comments on the proposed rule amendments. This documentation is required by the Administrative Procedure Act (RCW 34.05.325). The CES also provides Ecology's response to public comments on the draft Site Hazard Assessment and Ranking Process (SHARP) Tool and User Manual, which is necessary to implement the rule amendments
