Description Washington’s environmental cleanup law, the Model Toxics Control Act (MTCA), requires that cleanups not only protect your health and environment, but also use “permanent solutions to the maximum extent practicable.” Permanent solutions are preferred because they don’t require post-cleanup controls (such as land use restrictions) to be protective. However, permanent solutions may not always be practical. This focus sheet explains the difference between permanent and non-permanent solutions, practicability of a cleanup, and how to find the balance between practicability and permanence. This is intended to provide a general understanding of the concept. Ecology staff and other persons cleaning up contaminated sites should consult the permanent to the maximum extent practicable (PMEP) guidance and associated PMEP Tool and User’s Manual when performing these evaluations.
