Released From Restrictive (Environmental) Covenant
Environmental cleanup is complete at the site and no further cleanup actions are needed. Ecology is in the process of removing the Restrictive Covenant.
Ecology held a comment period from March 12 to April 11, 2020, and asked the public to comment on the proposal to remove the site from Restrictive Covenant No. 200301100792. We received one comment during the comment period. As there were no significant changes, we decided to remove the environmental covenant.

Site Description
The Site is an industrial area in the Tacoma tide flats. In the past, the Site occupied the northern portion of an area used by a lumber mill and storage facility (Fred Tebb & Sons, Inc.).
In 2012-2013, the northern section was subdivided into two new parcels (Pierce County parcel numbers 0320036003 and 0320036004). Now the Site is an open paved asphalt parking area with an above ground fuel tank and an office building.
Site Cleanup
In 1989, petroleum-contaminated soil was found when a 500-gallon gasoline/diesel underground storage tank was removed. About 270 yards of contaminated soil was removed from the former tank location.
Groundwater monitoring in 1992-1995 and 2000-2001 showed petroleum contamination was below state cleanup levels. However, some petroleum-contaminated soil was left in place under building structures. In 2003, a NFA letter was issued to Fred Tebb and Sons and the EC was recorded for the (parent) parcel 0320032042.
In 2012-2013, the parent parcel 0320032042 was subdivided into the current (children) parcels 0320036003 and 0320036004 and purchased by X2P Marc Land Associates. The structures that covered the contaminated soil were removed. Additional sampling for petroleum contamination in 2017 confirmed that soil was clean and petroleum contamination in groundwater was below cleanup levels. The EC for the two parcels was no longer required.
In 2020, the property owner requested removal of the two parcels from the EC.

This site was cleaned up under our Voluntary Cleanup Program, which provides technical help to owners of contaminated sites.
Voluntary Cleanup Program customers pay fees to cover our costs for technical help and reviewing cleanup reports. Sites in this program must meet the same cleanup standards as the sites Ecology manages under legal orders.
