Periodic Review Draft Report Completed

Ecology invites you to review and comment on the third draft Periodic Review report for the Colorado & North River Apartments Site:

2021 Periodic Review

Comments will be accepted November 18, 2021 through December 20, 2021.

You may submit your comments online or by mail to Jeff Newschwander, Periodic Reviewer, at Ecology's Central Regional Office.

A periodic review is conducted at least every five years after the initiation of a cleanup action at a Site when required by the Model Toxics Control Act (MTCA).  The purposes of the review are to evaluate Site conditions after cleanup is considered complete, and to ensure protection of human health and the environment when institutional controls are used as part of a remedy.

We will review comments received during the comment period and make recommendations for suggested changes.  The periodic review will become final if no significant changes are made.  An additional public comment period will be held if significant changes are made.

The Colorado and North River Apartment complex is located in a residential area to the north and west of downtown East Wenatchee.

An Environmental Site Assessment conducted in 1996 indicated the property was an orchard in the 1940s.  It was vacant from the 1950s until the 1990s.  In 1999, an apartment building was constructed at the Site.

In August 1997, soil sampling was conducted.  Samples were collected from depths ranging from 2 to 9 inches below ground surface (bgs).  All soil samples were analyzed for arsenic.  The sample with the highest level of arsenic was then selected to be analyzed for lead.

Laboratory analysis indicated concentrations of 270 parts per million (ppm) arsenic and 1100 ppm lead.  In addition, Toxicity Characteristic Leaching Procedure (TLCP) was completed for the same soil sample to whether or not it designated as a dangerous waste.  TCLP analytical results were reported below the Washington State dangerous waste values.

Based on the relatively low arsenic and lead concentrations, low leachability values of these metals, large volume of affected soils, significant depth to groundwater, and discussions with representatives from Ecology, it was determined that on-site containment would be an effective remedy for the Site.

In 1999, restrictive covenants were recorded for the two tax parcels that make up the Site.

Based upon cleanup activities and the recording of the restrictive covenants, Ecology determined the Site is no longer a threat to human health and the environment.  Ecology issued a No Further Action determination in June 1999.

Periodic reviews are conducted every 5 years by Ecology for sites that have Environmental Covenants and/or Institutional Controls. The review is intended to examine the effectiveness of cleanup activities and to assure the continued protection of human health and the environment.

Periodic Review Results

The Site continues to be occupied by the four apartment buildings that make up the Colorado and North River Apartment complex.  Asphalt, building structures and a clean soil cover continue to serve as a cap for the Site and eliminate the human exposure pathways (ingestion, contact) to contaminated soils.  Based upon the Site visits in April 2011, June 2016, and February 2021, no repair, maintenance, or contingency actions have been required.

The Restrictive Covenants for the Site were recorded and remain active.  The Restrictive Covenants prohibit activities that will result in the release of contaminants contained as part of the cleanup without Ecology’s approval, and prohibit any use of the property that is inconsistent with the Covenant.  These covenants serve to assure the long-term integrity of the surface cover.
