Comment Period Concluded - Agreed Order And Public Participation Plan

Ecology has entered into a legal agreement called Agreed Order (AO) DE 21135 with Albatross Estates, LLC. Albatross Estates, LLC, is the potentially liable person (PLP) responsible for additional cleanup at the Weyerhaeuser DuPont 1 a.k.a. Former DuPont Works cleanup site (Site). The agreement requires a plan for cleanup of contamination in some areas of the Site. By removing more contamination, areas of restricted land use will be made suitable for unrestricted (residential) land use.

Ecology held a comment period from October 6 to November 4, 2022 and made the AO and Public Participation Plan available for public review and comment. Site Description

The Weyerhaeuser DuPont cleanup site is located at 2301 Center Drive and adjacent properties. It began as DuPont Works, a factory that produced commercial explosive materials. Production, transportation, storage, and disposal of such materials on the site resulted in contamination from petroleum hydrocarbons, volatile organic compounds, metals, and solvents.

Current Status

Soil contamination was remediated through a series of interim actions, excavation, capping, and tree root zone remediation. Groundwater contamination was addressed through a monitoring program. An environmental covenant was also placed on the site to restrict certain types of land use.

In 2016, a periodic review was conducted at the site. The results of that review led to Ecology removing the site from its Hazardous Sites List, formally recognizing an effective cleanup. An environmental covenant remains on the site, which restricts certain types of land use. Following mandate from the Model Toxics Control Act (MTCA), periodic reviews will be conducted at this site every 5 years.

Site use restrictions called institutional controls are in effect

Institutional controls can be fences, signs, or restrictions on how the property is used. For instance, an institutional control may prohibit installing drinking water wells or disturbing a protective cap that isolates contamination. These restrictions keep the contamination contained and keep people from being exposed to the contamination. The controls are usually listed in environmental covenants recorded with the county.

Periodic reviews are required when institutional controls are required at a site. Ecology conducts reviews to make sure the controls remain effective and the cleanup still protects human health and the environment. We conduct periodic reviews about every five years.
