2025 Periodic Review
Ecology reviews sites about every five years after a cleanup action when institutional controls (an environmental covenant) are part of the cleanup. The purpose of the periodic review is to evaluate the effectiveness of the completed cleanup action (including the effectiveness of the environmental covenant), and whether human health and the environment are being protected.
2025 Periodic Review Results
The 2025 Periodic Review concluded that the completed cleanup action at the site appears to continue to be protective of human health and the environment. No additional cleanup actions are required by the property owner at this time. The complete findings and conclusions of the periodic review are provided in the report.
Site History
Environmental Covenant
Since 2001, the property has had a covenant.
Everett Smelter Area
The approximately 4.22-acre Property is located within the southeastern portion of the area designated as the Everett Smelter cleanup site (Cleanup Site ID 4298).
A smelter processing lead, gold, silver, and arsenic ore operated in the area from 1894 to 1912. It was discovered in 1990 that many of the properties surrounding the smelter were impacted by air emissions from the smelter stacks and had elevated levels of arsenic in soils.
Investigations
The first phase of remediation was conducted in August 2000, at which time it was discovered that the western portion of the Property had a deep layer of imported fill material.
The second phase of remediation occurred in early 2001 and included removal of remaining hotspots and some of the contaminated fill material.
Arsenic Cleanup
Across most of the Property, areas exceeding the cleanup level for arsenic (20 mg/kg) were excavated and re-sampled until cleanup standards were met. Within the 20-foot-wide landscape strip along East Marine View Drive, the cleanup goal was established at 500 mg/kg for arsenic at soil depths of 4 feet bgs and below. Within this landscape strip, a fabric was placed at the excavation bottom to separate the contaminant area from the clean soil boundaries to help future construction personnel.
Approximately 16,400 cubic yards (25,500 tons) of arsenic-contaminated soils above the state cleanup level (MTCA Method A) (20 mg/kg) were disposed of off-site.

Site use restrictions called institutional controls are in effect
Institutional controls can be fences, signs, or restrictions on how the property is used. For instance, an institutional control may prohibit installing drinking water wells or disturbing a protective cap that isolates contamination. These restrictions keep the contamination contained and keep people from being exposed to the contamination. The controls are usually listed in environmental covenants recorded with the county.
Periodic reviews are required when institutional controls are required at a site. Ecology conducts reviews to make sure the controls remain effective and the cleanup still protects human health and the environment. We conduct periodic reviews about every five years.
