State Cleanup Process

The Model Toxics Control Act (MTCA; Chapter 70.105D RCW) is Washington’s environmental cleanup law. It provides requirements for contaminated site cleanup and sets standards that protect human health and the environment. Ecology enacts the MTCA and oversees cleanups. The MTCA site cleanup process is completed in steps (see graphic) over a variable timeline.

In June 1990, Ecology detected elevated levels of gasoline constituents in domestic drinking water wells located down gradient of the property. A release from an underground storage tank (UST) system associated with a former Texaco service station was thought to be the source of the groundwater contamination.




The contaminants at this site above state cleanup standards in soil and groundwater are:

·         Gasoline-range petroleum hydrocarbons

·         Benzene

·         Toluene

·         Ethylbenzene

·         Xylenes

Site History

·         1992 - Ecology entered into a Consent Decree with the then-owner of the Site, B and C.B. Enterprises, Inc., in order to remediate the release of hazardous substances.​

·         1995 - Ecology installed a treatment system at the site.

·         1998 - The system was shut down in April and all the underground storage tanks were decommissioned and removed from the site in December.​

·         1999 - Fred Meyer Stores Inc. (Fred Meyer), purchased the property from B. and C.B. Enterprise, Inc. after Ecology determined that the proposed work plan would continue remediation of the site and satisfy the Consent Decree transfer provisions. Fred Meyer built a new gas station at the property. A new soil and groundwater treatment system was installed and operated from June 1999 through May 2000. The system was rebuilt in late 2008 and is currently operating. Groundwater monitoring has been conducted at the site from 1990-present.​

·         2011 - In April, Ecology notified B. and C.B. Enterprises, Inc. that neither B. and C. B. or Ecology have any further obligation under the Consent Decree.

·         2012 - Ecology and Fred Meyer Stores Inc. entered into an Agreed Order for this site. Under the Agreed Order, Fred Meyer agreed to:

      • Continue quarterly monitoring at the site wells.
      • Continue to operate an existing subsurface remediation system until cleanup levels are met in all wells.
      • Evaluate the remediation system quarterly to determine if it is working property.
      • Evaluate potential contingency plans if the remediation system has not meet cleanup standards by the second quarter of 2015.
      • Develop a contingency plan that identifies an alternative cleanup action that can be implemented if Ecology concludes that additional remedial actions are required.
      • A Remedial Investigation report that presents the results of site investigations.
      • A Feasibility Study (FS) and Draft Cleanup Action Plan (DCAP). The FS/DCAP evaluated cleanup alternatives and described the cleanup alternative that was implemented in 1998 to clean up the site.

·         2015 - Fred Meyer Stores Inc. completed the cleanup at the Site and performed compliance groundwater monitoring.

·         2015 - Ecology has determined that no further remedial action is necessary at this Site. Ecology has also determined that no post-cleanup or monitoring are necessary.

·         30 day public comment period (May 29-June 29, 2015) to delist the Site from the Hazardous Sites List.

·         The Site was taken off the Hazardous Sites List in August 2015.

·         December 2015 Ecology issued determination of Satisfaction of Agreed Order No. DE 9040 and No Further Action.
